Good morning my name is Patricia Yates and I have a legal question regarding the soft redistricting plan that the school board of Brevard county is proposing. I live in Port St. John and my children currently attend Atlantis Elementary School. We live in the area that has been designated by the school board to fill Clearlake Middle school in Cocoa. My question is ... right now my representative is Robert Jordan. If my children are sent to Clearlake then the representative for that school district is Barbara Murray. When any type of vote comes up on a ballot I can only vote for items concerning Jordan and the schools in his district because this is the district I live in. I can not vote on anything pertaining to Murray or the schools in her district. I have asked this question of several people and have yet to receive an answer that addresses whether or not I will be denied the right to vote on who oversees the school district it is proposed that my children will be attending and the choices and decisions that will affect the district that Clearlake is located in. I have seen school board numbers that prove that at least 146 students who should be attending Clearlake have been allowed to enroll in other schools of their choice but my children are being forced to go to the school that Cocoa students have chosen not to attend. Can you help me in this issue? There seems to be some miscommunication by certain members of the school board to elected officials as to who exactly will be affected by their proposed "soft redistricting". Thank you, Patricia Yates.
This is the response I received from Truman Scarbourough's office:
Ms. Yates:
Your question regarding issues related to voting has been copied to Fred Galey, Supervisor of Elections for Brevard County. With respect to issues surrounding “soft redistricting”, I have taken the liberty of forwarding your e-mail to Dr. Ron Bobay, Area 4 School Board Superintendent.

Well, here was the response I got from the Brevard County Elections Office ... just another pass off. Seems no one wants to admit that there might be a legitimate issue here.
Dear Ms. Yates,
Our office simply administers elections -- we do not determine school board district lines nor whether board members are elected in single member districts or at-large. You should contact the Brevard County school board in regard to this issue. Contact information for the superintendent and board members can be found at http://www.brevardelections.org/county.htm#schbd. If we can be of further assistance to you, please contact us again.

Has anyone thought about AYP(Average Yearly Progress)? I know that Clearlake has not made it yet. It has had no the first year, provisional the next 2 and finally a no this past year. If they continue, we would have the opportunity to be bused to a choice school that has made AYP as a result. So why send our children to a school that has not made AYP yet? Makes you wonder if they are trying to use us to make AYP and stop additional busing out of Clearlake.
